This Privacy Statement outlines how we handle information that can be used to directly or indirectly identify an individual ("Personal Data") and processing based on a statutory permission.

Personal information is data that can be used to identify or contact a single person.

You may be asked to provide your personal information anytime you are in contact with ICHR or an ICHR affiliated company. ICHR and its affiliates may share this personal information with each other and use it consistent with this Privacy Policy. They may also combine it with other information to provide and improve our products, services, content, and advertising. You are not required to provide the personal information that we have requested, but, if you chose not to do so, in many cases we will not be able to provide you with our products or services or respond to any queries you may have.

How we use your personal information

We may process your personal information: for the purposes described in this Privacy Policy, with your consent, for compliance with a legal obligation to which ICHR is subject, for the performance of a contract to which you are party, in order to protect your vital interests, or when we have assessed it is necessary for the purposes of the legitimate interests pursued by ICHR or a third party to whom it may be necessary to disclose information.

The personal information we collect allows us to keep you posted on ICHR’s latest product announcements, software updates, and upcoming events. If you don’t want to be on our mailing list, you can opt-out anytime by updating your preferences.

Source of your personal information where they are not collected from you

We may have received your personal information from other persons/firms if that person has shared their content with you using ICHR products, or invited you to participate in ICHR services or forums. We may also validate the information provided by you when creating an ICHR ID with a third party for security and fraud prevention purposes.

If you are a potential candidate for employment with ICHR, we may have received your personal information from third parties such as recruiters or external websites. We will use the personal information we receive to contact you about a potential opportunity or in evaluating your candidacy. If you did not provide us your personal information directly, we will inform you of the source when we first contact you regarding your candidacy. For research and development purposes, we may use datasets such as those that contain images, voices or other data that could be associated with an identifiable person. When acquiring such datasets, we do so in accordance with applicable law in the jurisdiction in which the dataset is hosted. When using such datasets for research and development, we do not attempt to re-identify individuals who may appear therein.

 

Collection and Use of Non-Personal Information

We also collect data in a form that does not, on its own, permit direct association with any specific individual. We may collect, use, transfer, and disclose non-personal information for any purpose. The following are some examples of non-personal information that we collect and how we may use it:

 

Processing based on a statutory permission

Processing to fulfill contractual obligations. ICHR requires your Personal Data to deliver goods or services you order under a contract ICHR has with you, to establish a contract for goods or services between you and ICHR, or to send you invoices for ordered goods or services. ICHR processes Personal Data to fulfill contractual obligations pursuant to Article 6(1), lit. b GDPR. 

Processing when necessary to fulfill ICHR’s contractual obligation includes responding to your related inquiries, processing your feedback or providing you with support. This can also include conversation data that you may initiate or enable such as through the chat functionalities on ICHR.com or other local ICHR web presences, through contact forms, emails, or by telephone. In this Privacy Statement, “goods and services” includes access to ICHR’s web services, offerings, contests, sweepstakes, other content, non-marketing related newsletters, whitepapers, tutorials, trainings and events.

Furthermore, ICHR communicates on a regular basis by email with users who subscribe to its services and will also communicate by phone to resolve your or other customer complaints or to investigate suspicious transactions.

ICHR will use your email address to confirm your opening of an account, to send you notice of payments, to send you information about changes to its products and services, and to send notices and other disclosures as required by law. Generally, users cannot opt out of these communications because these communications are required for the relevant business relationship and not marketing-related in nature.

ICHR DISCLAIMS ANY AND ALL LIABILITY FOR THE ACTS, OMISSIONS AND CONDUCT OF ANY THIRD PARTIES IN CONNECTION WITH OR RELATED TO YOUR USE OF THE SITE AND/OR ANY ICHR SERVICES. YOU ASSUME TOTAL RESPONSIBILITY FOR YOUR USE OF THE SITE AND ANY LINKED SITES. YOUR SOLE REMEDY AGAINST ICHR FOR DISSATISFACTION WITH THE SITE OR ANY CONTENT IS TO STOP USING THE SITE OR ANY SUCH CONTENT. THIS LIMITATION OF RELIEF IS A PART OF THE BARGAIN BETWEEN THE PARTIES.

The above disclaimer applies to any damages, liability or injuries caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction of or unauthorized access to, alteration of, or use, whether for breach of contract, tort, negligence or any other cause of action.

ICHR reserves the right to do any of the following, at any time, without notice: (1) to modify, suspend or terminate operation of or access to the Site, or any portion of the Site, for any reason; (2) to modify or change the Site, or any portion of the Site, and any applicable policies or terms; and (3) to interrupt the operation of the Site, or any portion of the Site, as necessary to perform routine or non-routine maintenance, error correction, or other changes.

 

Limitation of Liability

Except where prohibited by law, in no event will ICHR be liable to you for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even if ICHR has been advised of the possibility of such damages.

If, notwithstanding the other provisions of these Terms of Use, ICHR is found to be liable to you for any damage or loss which arises out of or is in any way connected with your use of the Site or any Content, ICHR’s liability shall in no event exceed the greater of (1) the total of any subscription or similar fees with respect to any service or feature of or on the Site paid in the six months prior to the date of the initial claim made against ICHR (but not including the purchase price for any ICHR hardware or software products or any ICHRCare or similar support program), or (2) US$100.00. Some jurisdictions do not allow limitations of liability, so the foregoing limitation may not apply to you.

 

Indemnity

You agree to indemnify and hold ICHR, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against ICHR by any third party due to or arising out of or in connection with your use of the Site.
